§ 4.20.06. Health Insurance Portability and Accountability Act.

City and hospital agree that on or before the compliance date set forth in applicable regulations, they and each of them shall comply with the Health Insurance Portability and Accountability Act and its attendant privacy regulations, 45 C.F.R. parts 160 through 164, as amended from time to time ("HIPAA"), in processing, receiving, maintaining, or disclosing any member medical records or information constituting protected health information ("PHI") as defined under HIPAA, and further that they and each of them shall at all times upon and after the HIPAA compliance date protect the privacy and confidentiality of such PHI as required by HIPAA.
